President Heithoff called the Special April 2008 Elgin Public School Board Meeting held in the Elgin Public School Lunchroom to order at 5:36 PM. Board members present were Steve Heithoff, Stan Heithoff, Laurie Waterbury, Bruce Anderson, Mary Bauer, and Scott Beckman. Also present were Superintendent Fredrickson, Principal Fisher, Mrs. Janie Score, Martin Klein, Kelly Baker, Doug Stratton and several guests.
President Heithoff reminded everyone that a copy of the Nebraska open meetings law was posted in the meeting room.
School board meeting notice complied with Meeting Notice Policy # 204.07.
Waterbury moved, Anderson seconded, to approve the agenda. Voting yes were- Steve Heithoff, Stan Heithoff, Bauer, Anderson, Waterbury, Beckman. Motion passed on a 6 to 0 yes vote.
Stan Heithoff moved to hire Doug Stratton as the Elgin Public School Board legal counsel and hearing officer, to represent the Board and preside over the employment hearing. Bauer second. Motion passed on a 6 to 0 yes vote. Voting yes- Steve Heithoff, Stan Heithoff, Bauer, Anderson, Waterbury, Beckman.
Mr. Stratton then assumed the role as hearing officer, and conducted the employment hearing of Janie Score. Mr. Stratton outlined the process, and explained that a court recorder was present to record the hearing. In response to motion for closed session by attorney Klein, and after receiving an opinion from Mr.Stratton, Steve Heithoff moved to conduct the hearing in open session. Stan Heithoff seconded the motion and it carried on a 6-0 yes vote. Voting yes- Steve Heithoff, Stan Heithoff, Bauer, Anderson, Waterbury, Beckman. The hearing and testimony resumed. The recorder was excused at 10:08 PM. Then hearing attorneys Baker and Klein, presented closing remarks.
President Steve Heithoff then reassumed the chair, at 10:25 PM.
Anderson moved, Waterbury second, to enter closed session to consider issues and evidence presented to the Board in the matter of the Score employment hearing, and to prevent the needless injury to the reputation of the individual. The motion carried on a unanimous 6 to 0 yes vote. Voting yes- Steve Heithoff, Stan Heithoff, Bauer, Anderson, Waterbury and Beckman.
The Board entered closed session at 10:26 PM.
The Board returned to open session at 12:44 AM, April 10, 2008.
President Heithoff entertained any motion regarding the hearing this evening.
Beckman moved to adopt the finding of fact and the decision to terminate. Waterbury second. Motion passed on a 6 to 0 yes vote. Voting yes- Steve Heithoff, Stan Heithoff, Bauer, Anderson, Waterbury, and Beckman.
Attorney Stratton then presented, and read aloud the finding of fact, and the decision to terminate into the record.
Motion to adjourn by Bauer, second by Stan Heithoff. The motion to adjourn passed with a unanimous yes vote. Voting yes- Steve Heithoff, Stan Heithoff, Bauer, Anderson, Waterbury, and Beckman. Meeting adjourned at 1:00 AM April 10, 2008.
